Purchase Terms for Subscriptions & Digital Products
Effective date: 11 September 2025
These Purchase Terms (“Purchase Terms”) govern purchases of subscriptions and other digital products from Jennie and Philip Marlow on the lowcarbforlovers.com website (“we,” “us,” “our”). These terms supplement our Terms & Conditions, which include the Conditions of Use, Privacy Policy, and Disclaimer and Limitation of Liability. If these terms and conditions conflict, these Purchase Terms control for paid purchases.
1) Products & Access
• “The Supper Club” is a recurring subscription that unlocks access to gated content (recipes, menus, posts, tools and features) while your plan is active.
• Subscriptions are for personal, non-commercial use by the single account holder. Sharing, resale, redistribution, or public re-posting are not permitted.
• We may add, modify, or retire features/content. Material changes won’t reduce core access during your current paid term.
2) Plans, Pricing & Founding-Member Offer
• Standard pricing: $4/month or $40/year.
• Founding Members: Limited-time $27/year rate, which will remain in force while the subscription remains continuously active. If you cancel or a renewal payment fails and the plan lapses, you may lose this Founding Members rate.
• Prices may change prospectively. We’ll provide notice before your next renewal if your price is changing.
3) Free Trial (Founding Members Only)
• A 7-day free trial is available only with the Founding-Member annual plan, for a limited time, one trial per person/household/payment method.
• After 7 days, your card is charged the then-current Founding-Member annual price unless you cancel within the trial period. To cancel, visit Manage My Account.
• We may terminate access for suspected trial abuse or duplicate accounts.
4) Billing, Auto-Renewal & Cancellations
• All plans renew automatically at the end of each billing cycle (monthly or annually) until canceled.
• Monthly plans: charged at purchase and each month on the renewal date.
• Annual plans: charged at purchase (or after trial, if applicable) and each year on the renewal date.
• You can cancel auto-renewal of your membership up to 2 business days before the renewal date by visiting Manage My Account, or by email to support@lowcarbforlovers.com.
• Cancellation stops future charges; access continues through the end of the current paid term.
• Deleting your account or failing to use the service does not cancel.
• You authorize us (and our payment processors) to store and use updated card details provided by your bank or network.
5) No Refunds (Except Where Required by Law)
• All fees are non-refundable and non-transferable, including partial-periods, unused time, or downgrades, except where a refund is required by applicable law.
• If we suspend or terminate your account for breach or misuse, payments are not refunded.
6) Failed Payments
• If a payment fails, we may retry your card, notify you, limit access, or suspend the subscription. If not resolved within a reasonable time, we may cancel your plan. Re-activation may require current pricing.
7) Discounts, Coupons & Gifts
• Discount codes apply once unless stated otherwise, have no cash value, and can’t be combined.
• Gift subscriptions are prepaid, non-refundable, and activate upon redemption.
8) Prohibited Uses
• No scraping, bulk downloading, re-publishing, AI training, commercial use, classroom redistribution, or sharing of paid content outside your household account.
9) Taxes
• Prices exclude applicable taxes unless stated. You’re responsible for any sales/VAT/GST or similar taxes where required.
10) Price & Plan Changes
• We may change plan names, features and prices. Changes apply upon your next renewal with prior notice to your account email.
11) Chargebacks
• You agree to contact support@lowcarbforlovers.com to resolve billing issues before disputing a charge. Unfounded chargebacks may result in account suspension and collection of associated fees.
12) Third-Party Services
• We use third-party processors (e.g., Stripe) and membership software (e.g., aMember). Your use of payment services may be subject to their terms and privacy notices.
13) Termination
• We may terminate or suspend accounts for fraud, misuse, or violations of these terms or applicable laws. Upon termination, your license to access paid content ends.
14) Consumer Rights in the EU and UK
For customers with EU/UK consumer rights: by accessing digital content immediately, you acknowledge the statutory “cooling-off” right may not apply or may be waived once access begins. These rights vary by country; nothing here limits non-waivable consumer rights. If you are a consumer located in the European Union, United Kingdom, or another jurisdiction with mandatory consumer rights, you may have additional statutory rights. Nothing in these Purchase Terms affects those rights. Key points under EU/UK law include:
• You may have a legal right to withdraw from your subscription purchase within 14 days of purchase (the ‘cooling-off period’).
• By starting access to digital content immediately after purchase (or free trial conversion), you acknowledge that the statutory withdrawal right may not apply or may be waived once access begins.
• If you exercise your right of withdrawal within the cooling-off period and before accessing the digital content, we will refund your payment in accordance with applicable law.
• These rights vary by country; consult your local consumer protection authority for details.
15) Discontinuation of Service / Website Closure
• We reserve the right to discontinue The Supper Club subscription or shut down the lowcarbforlovers.com website at any time, in our sole discretion. We will make reasonable efforts to notify active subscribers at least 30 days before discontinuation.
• If we permanently discontinue paid subscriptions before the end of your current paid term, you will receive a pro-rated refund for the unused portion of your subscription, unless the discontinuation is due to circumstances beyond our reasonable control (Force Majeure).
• No further content or services will be provided after the effective discontinuation date. Your license to access paid content will end on that date.
• We are not liable for any loss, inconvenience, or cost arising from the closure of the website or discontinuation of services beyond the pro-rated refund described above.
16) Disputes, Governing Law & Venue
• As stated in our Conditions of Use, Oregon law governs. Mediation and, if needed, binding arbitration will be conducted in Portland, Oregon (AAA rules). Claims must be brought individually (no class actions).
